All organizations or individuals bidding on contracts, with a contract price in excess of $55,000, derived from competitive bidding, competitive negotiations, or non-competitive negotiations, on construction or maintenance projects for the Pulaski County School District (PCSD) shall be prequalified and possess a certificate of eligibility issued by the Pulaski School District. The certificate shall state the maximum eligibility amount and types of work for which the contractor is qualified. All Certificates of Eligibility shall terminate not later than 120 days after the end of applicant's fiscal year unless suspended or revoked. Ninety (90) days of this period is to permit the applicant to file a revised application, and thirty (30) days is for the Committee's review of the application and, if approved, the issuance of the new Certificate of Eligibility. The Certificate of Eligibility in effect as of the bid opening date shall constitute the basis for determining the eligibility of a bidder. An organization or individual desiring to be prequalified shall submit a PCSD Contractor's Prequalification Statement (CPS) form in the following order.
- Applicants desiring prequalification for bidding contracts in excess of $1,000,000 shall complete the following packet and attach their latest certified audit report under separate cover.
- Applicants desiring prequalification for bidding contracts $100,000 to $1,000,000 shall complete the CPS, the following packet and attach their latest certified audit report under separate cover.
- Applicants desiring prequalification for bidding contracts less than $100,000 shall complete the CPS, the following packet, and attach the most recent copy of their income tax report to the Internal Revenue Service.

The bidder will be required to establish to the satisfaction of the Architect and Owner the reliability and responsibility of the persons or entities proposed to furnish and perform the work described in the Bidding Documents.
Prior to the award of the contract, the Architect will notify the Bidder in writing if either the Owner or Architect, after due investigation, has reasonable objection to a person or entity proposed by the Bidder. If the Owner or Architect has reasonable objection to a proposed person or entity, the Bidder may, at the Bidders option, (1) withdraw the bid, or (2) submit an acceptable substitute or person or entity with an adjustment in the Base Bid or Alternate Bid to cover the difference in cost occasioned by such substitution. The Owner may accept the adjusted bid price or disqualify the Bidder. In the event of either withdrawal or disqualification, bid security will not be forfeited.
Persons and entities proposed by the Bidder and to whom the Owner and Architect have made no reasonable objection must be used on the Work for which they were proposed and shall not be changed except with the written consent of the Owner and Architect.
This option will be invoked by either the Owner or the Architect based only on documented situations, including but not limited to the following:
- History of substandard work that delayed the completion of the overall project.
- Negligent assembly of components or subcomponents.
- Omission of key elements or subcomponents.
- Use of substandard components, sub-components or materials.
- Use of personnel whose training is not commensurate with the level of expertise required for the task at hand.
- Surety Company indicates past history of failure to satisfactorily complete projects.
- Documented tendency to not respond to orders to perform in the sequence of activity required.
